Dealing with Rejection

From the 1st of October the ‘Sales of Goods Act 1979’ will be replaced by the ‘Consumer Rights Act 2015’ which gives new rights to consumers – this has implications for motor dealers as the act gives customers the “short term right to reject” a vehicle within 30 days of purchase without the dealer being given any opportunity to repair it.

To exercise this right, the customer must prove there is a fault – and also prove that it was present at the point of sale. However, a customer cannot return a vehicle for just any fault. For the purposes of the act the fault must be such that it renders the vehicle not of satisfactory quality, not fit for particular purpose or not as described.

If the customer reports a fault to the dealer after 30 days have passed, then they must give the dealer the opportunity to repair the vehicle – but the customer can still reject if the first repair is unsuccessful or should another fault occur.

Within our Dealer Management System, we have made the appropriate changes to our vehicle sales disclaimers to reflect these new rules. These changes have been approved by Lawgistics who specialise in Motor Trade legality. The new disclaimers will be provided to all new Dragon2000 users by default. Existing Dragon2000 software users who require changes to their bespoke disclaimers, or would prefer to have the Lawgistics approved set, simply need to contact our support team.

These changes are only available for those users running Dragon DMS2015 or later – they are not available for those still on version 9.3 or 9.5 of Dragon2000.
